DMCA Notice & Copyright Policy

Avery XO respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act ("DMCA"), we have designated an agent to receive notifications of claimed copyright infringement.

1. Filing a Takedown Notice

If you believe that any material or image hosted on our website infringes upon your copyright, you may submit a formal notification of infringement. To be valid under the DMCA, your notice must be in writing and include the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the infringed copyright.

  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Counter-Notification Procedures

If you believe that your content was removed by mistake or misidentification, you may submit a counter-notification under the DMCA. The counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and the URL location at which it appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original takedown notice.

3. Repeat Infringer Policy

In accordance with the DMCA, we reserve the right to terminate access to this website or ban individuals who are determined to be repeat infringers of copyright claims.
